Emma Woodhouse and Cher Horowitz are clones placed in two different time periods. Emma resides in the village of Highbury in the early 100's, while Cher lives in contemporary Beverly Hills. When Cher tries to pair Tai with Elton, she puts all her efforts into having Tai "fit" into the social status of the rest of her friends. The court used a test from a previous case to make a decison. In the decision of Katz v. U.S., the court held that by using an eavesdropping device to listen to a conversation in a phone booth was unconstitutional. The petitoner by going into the phone booth to make a phone call and by closing the door to the booth had a reasonable expectancy of privacy. From this decison a test was made called the Katz test, it asked the question did the subject have an expectancy of privacy that the society would see as reasonable. The interior of a house is the most private area and has a reasonable expectancy of privacy. The government agrued that it was just a visual search and the device used was to measure heat off the wall and not through the wall. In Dow Chemical Co. v. U.S. , the govt. took aerial pictures of an industrial complex and the court up held the decison to use those pictures becuase it did not share fourth ammendment priveldges like a private home. The justices in reviewing the facts of the case came to the conclusion that no significant compromise of privacy had occured by using that device but they had to take into consideration the original purpose of the Fourth ammendment. The court reasoned that by using a device that was not in public use to explore details of a house which would have been unknown without physically intruding was infact a search. The judgement of the court of appeals is reversed.

When Heathcliff gives up his plan for revenge, he meets Catherine in death and truly becomes happy once more.


Catherine's revenge does not make things better for her. Her revenge on Heathcliff by blaming him for her upcoming death does not meliorate her mind. Just before she dies, she ascribes Heathcliff for her "murder." "You have killed me, and thriven on it, I think" (Bronte 158). Catherine resembles what Oliver Goldsmith said, "When lovely woman stoops to folly, and finds too late that men betray, what charm can soothe her melancholy? What art can wash her guilt away? The only art her guilt to cover, To hide her shame from every eye, To give repentance to her lover, And wring his bosom, isto die" (Oliver Goldsmith 1). Catherine's death is caused by her lack of emotional control and her dual personalities. She and Heathcliff "are" each other (Bronte 80), but her wants of social status and popularity draw her toward Edgar (Bronte 78). She does not love Edgar, but her selfish material wants control her. Catherine's revenge on Heathcliff does not assist her in finding happiness. She looks forward to dying and is "wearying to escape into that glorious world" (Bronte 160). Her death is, however, miserable as she wanders around the earth as a waif for 0 years occasionally visiting Heathcliff and torturing him.

Statement of the problem


In 177, Allan Bakke sued the University of California based on the fact that he had been denied to the admission of University of California Davis Medical School due to the fact that the University had reserved a number of spots for minority students quota system with lower GPA and MCAT scores. He claimed that he deserved to be admitted to the University, but had been denied twice because minority applicants with lower qualification were given advantage and priority based on their races. Ever since the case of Regents of the University of California v. Bakke 177, the issue of affirmative action specifically race-based affirmative action in admissions has been the center of a number of debates. I will explain why reinstating race-based affirmative action is consistent with the intent of the Equal Protection Clause of the Fourteenth Amendment. I will also argue why the society and citizens within need to realize that race-based affirmative action is not about putting burdens on innocent individuals; it is about providing minorities with opportunities. In order to draw the conclusion, the arguments of both advocates and opponents of the affirmative action will be presented in such a manner where the advocates' arguments dispute opponents' arguments. While educators have spent the last several years debating issues of quality and accountability in schooling, two fairly recent events have focused at least some attention on the issue of equality in education. In the summer of 15 the Board of Regents of the University of California system voted to "stop admitting students, hiring professors, and awarding contracts on the basis of race." The announcement that all affirmative action considerations would be removed from the largest state system of higher education caused an immediate public outcry. In April of 001, the Fifth Circuit Court handed down a decision in a case challenging the legitimacy of affirmative action based admissions practices at the University Of Texas Law School. It stated, effectively, that race might not be considered as a factor in the admissions process.
